These SMS Program Terms ("SMS Terms") govern the recurring text message program (the "Program") offered by Uproot Lint LLC, a Florida limited liability company doing business as Uproot Clean ("Uproot Clean," "we," "us," and "our"). These SMS Terms are part of, and incorporated into, the Uproot Clean Terms of Use Agreement (the "Terms of Use"). By opting in to the Program, you agree to these SMS Terms and to the Terms of Use, including the agreement to resolve disputes through binding individual arbitration and the class action waiver in the section of the Terms of Use titled "Dispute Resolution; Agreement to Arbitrate." These SMS Terms replace all prior mobile message and SMS/MMS program terms posted on the Website, including terms issued under the names Uproot Lint LLC and Uproot Lint Pro.

NOTICE OF ARBITRATION. ANY DISPUTE ARISING OUT OF OR RELATED TO THE PROGRAM OR ANY TEXT MESSAGE, INCLUDING ANY CLAIM UNDER THE TELEPHONE CONSUMER PROTECTION ACT OR ANY STATE TELEMARKETING OR TEXT MESSAGE LAW, WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION AS PROVIDED IN THE TERMS OF USE, AND YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Consent to Receive Text Messages

When you opt in to the Program, including by entering your mobile telephone number in a sign-up form, pop-up, game, or checkout field and checking a box or clicking a button, by replying "YES" or another keyword to a confirmation message, or by texting a keyword to our short code, you expressly agree that Uproot Clean and its service providers may send recurring automated marketing and informational text messages (SMS and MMS) to the mobile number you provided, including messages sent using an automated system for the selection and dialing of telephone numbers. Messages may include promotions, discounts, product announcements, cart and checkout reminders, order and shipping updates, subscription and account notices, and requests for reviews. Your checking of a box, clicking of a button, or affirmative text reply is your electronic signature on this agreement.

Your consent is not required, directly or indirectly, as a condition of purchasing any property, goods, or services. You may purchase from Uproot Clean without joining the Program.

You represent that you are eighteen (18) years of age or older, that you are the subscriber or the regular user of the mobile number you provide, and that you are authorized to consent to receive text messages at that number. If you change or give up your mobile number, you agree to text STOP from that number or notify us at help@uprootclean.com before you do, so that we do not send messages to the next person assigned that number.

Message Frequency and Charges

Message frequency varies. Message and data rates may apply. Uproot Clean does not charge for the Program, but you are responsible for all charges imposed by your wireless carrier. Check your mobile plan and contact your wireless carrier for details.

Message Timing and Your Time Zone

How We Schedule Messages

Uproot Clean schedules marketing text messages to be delivered between 8:00 a.m. and 8:00 p.m. in the time zone that Uproot Clean associates with your mobile number (the "Delivery Window"). Uproot Clean cannot see where your mobile device is located when a message is delivered. Instead, Uproot Clean uses the time zone associated with the area code of your mobile number or, if you have given us a different time zone as described below, the time zone you gave us (in either case, your "Designated Time Zone").

Your Obligation to Tell Us When You Move

Mobile numbers stay the same when people move, so the area code of your number may not reflect where you live. If you live in, move to, or will be staying for an extended period in a time zone that is different from your Designated Time Zone, you agree to notify Uproot Clean by texting the word ZIP followed by your current five-digit ZIP code to the number from which you receive our messages, or by emailing help@uprootclean.com with the subject line "Text Message Time Zone" and your mobile number and current ZIP code. Uproot Clean will update your Designated Time Zone within ten (10) business days after receiving your notice. Uproot Clean may have other information that suggests where you are, such as a shipping or billing address or an IP address, but Uproot Clean uses that information for other purposes and does not use it to schedule text messages. You agree that Uproot Clean is not required to infer a change in your Designated Time Zone from any source other than a notice you give under this section.

Your Express Invitation and Permission

By opting in to the Program, you give Uproot Clean your prior express invitation and permission to deliver text messages to your mobile number at any time within the Delivery Window in your Designated Time Zone, even if that time falls before 8:00 a.m. or after 9:00 p.m. (or any other hour) at the location where you or your mobile device actually are when the message is delivered. You agree that every message delivered within the Delivery Window in your Designated Time Zone is sent with your prior express invitation and permission and, therefore, is not a "telephone solicitation" as that term is defined in 47 U.S.C. § 227(a)(4) or an unsolicited call or message under any similar state law.

Waiver of Time-of-Day Claims

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE NOT TO BRING, AND YOU WAIVE AND RELEASE, ANY CLAIM AGAINST UPROOT CLEAN OR ITS SERVICE PROVIDERS UNDER 47 U.S.C. § 227(c), 47 C.F.R. § 64.1200(c)(1), OR ANY STATE STATUTE, REGULATION, OR ORDINANCE THAT RESTRICTS THE HOURS DURING WHICH TELEPHONE SOLICITATIONS, TELEPHONIC SALES CALLS, OR TEXT MESSAGES MAY BE SENT, TO THE EXTENT THE CLAIM IS BASED ON A MESSAGE THAT WAS DELIVERED WITHIN THE DELIVERY WINDOW IN YOUR DESIGNATED TIME ZONE BUT OUTSIDE PERMITTED HOURS AT YOUR ACTUAL LOCATION, INCLUDING BECAUSE YOU MOVED TO OR WERE TRAVELING IN A DIFFERENT TIME ZONE AND DID NOT NOTIFY UPROOT CLEAN AS PROVIDED ABOVE AT LEAST TEN (10) BUSINESS DAYS BEFORE THE MESSAGE WAS SENT.

If you do not want to receive messages under these terms, do not opt in to the Program, or text STOP at any time.

How to Opt Out

You may opt out of the Program at any time by replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to any text message from us, or by any other reasonable method that clearly tells us that you no longer want to receive text messages, including by emailing help@uprootclean.com with your mobile number and a request to stop text messages. After you opt out, you may receive one (1) final message confirming your opt-out, and you will receive no further marketing text messages unless you opt in again. We will honor opt-out requests promptly, and in any event within the time required by law. If you are enrolled in more than one Uproot Clean text program, your opt-out will apply to all of them unless you tell us otherwise.

Help

For help, reply HELP to any message or email help@uprootclean.com. Messages are sent from short code [877668] and may be sent from other short codes, toll-free numbers, or long codes that Uproot Clean uses for the Program. Uproot Clean may change the numbers it uses for the Program at any time, and messages you send to a number we no longer use may not be received.

Carriers and Delivery

The Program is available on most major U.S. wireless carriers. Wireless carriers are not liable for delayed or undelivered messages. Delivery of text messages depends on your wireless carrier and is outside Uproot Clean's control. To the extent permitted by law, Uproot Clean is not liable for any failed, delayed, or misdirected delivery of any text message, any errors in any text message, or any action you take or do not take in reliance on a text message.

Privacy

Uproot Clean's collection and use of information in connection with the Program is described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except with the service providers that help us operate the Program and deliver text messages, and except as required by law.

Florida Residents

For purposes of compliance with Florida law, Uproot Clean may presume that you are a Florida resident if the mobile number you used to opt in has a Florida area code. If you are a Florida resident, you agree that text messages sent in response to a message or request from you, including keyword responses, opt-in and opt-out confirmations, HELP responses, and order or shipping updates, are not unsolicited telephonic sales calls.

Before Bringing a Claim

Before you bring any claim against Uproot Clean arising out of or related to the Program or any text message, you agree to (i) reply STOP to the number from which you received the message, if you no longer wish to receive messages, and (ii) send Uproot Clean a Notice of Dispute and participate in the informal dispute resolution process described in the Terms of Use. If you believe that you received a message outside permitted hours, please tell us in your Notice of Dispute where you were located and the time zone in which you received the message.

Dispute Resolution

The section of the Terms of Use titled "Dispute Resolution; Agreement to Arbitrate," including its class action and jury trial waiver and your right to opt out of arbitration, applies to any dispute between you and Uproot Clean, and to any dispute between you and any service provider that sends text messages on Uproot Clean's behalf, arising out of or related to the Program or any text message. Uproot Clean's text message service providers are intended third-party beneficiaries of this section.

Changes to These SMS Terms

Uproot Clean may modify or end the Program or change these SMS Terms at any time. Changes will apply to you as provided in the section of the Terms of Use titled "Changes to This Agreement." If you do not agree to a change, you may opt out of the Program at any time by texting STOP.
